1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Digital swecha AI platform ("Service"), provided by Gangadhar Bokkena Learning Academy ("Digital swecha AI," "we," "us," or "our").
By subscribing to or using the platform, you ("Client," "User," or "Agency Owner") agree to be bound by these Terms. If you do not accept these Terms in full, you may not access or use the platform.
Digital swecha AI is a branded SaaS infrastructure that enables clients to build and operate their own software platforms under their own name and business entity. We serve strictly as technology and development partners and do not participate in the operation, finance, or customer service of your business.
2. Subscription Plans
We offer three subscription models:
Monthly Plan
Quarterly Plan
Annual Plan
Each plan includes access to our SaaS infrastructure, branded deployment, feature modules, and technical onboarding (as per selected plan tier). Your access continues based on active payment status. Late or failed payments may lead to service suspension.
3. Refund Policy
To ensure peace of mind, we offer a 3-day, no-questions-asked refund policy for all new subscriptions.
Refunds must be requested within 72 hours of the initial subscription or activation.
Refunds are not available for renewals, upgrades, or ongoing services beyond the 3-day window.
Refunds will be processed using the original mode of payment.
After the refund window closes, all sales are considered final.
4. Client Identity and Brand Use
All platforms launched using Digital swecha AI must be operated under your own brand name, entity, and business identity.
You are not permitted to use "Digital swecha AI" or "Gangadhar Bokkena Learning Academy" in any marketing, branding, or customer-facing materials unless explicitly authorized in writing.
Any misuse of the Digital swecha AI name, logo, assets, documentation, or association will result in immediate suspension and legal action where applicable.
5. Ownership and Responsibility
You are fully responsible for your business operations, including platform content, marketing, pricing, customer support, compliance, and legal obligations.
All customer payments must be processed through your own payment gateway and business bank accounts.
Digital swecha AI does not control your transactions, sales, or customers.
6. Limitation of Liability
Digital swecha AI is strictly a technology infrastructure provider. We do not engage in:
Sales or marketing to your end-users
Payment collections or financial reconciliation
Handling disputes, refund claims, or service delivery to your customers
As such, we hold no liability whatsoever for:
Any financial gains or losses incurred by you
Refund claims or disputes raised by your users
Regulatory or legal issues arising from your business operations
Brand misrepresentation, non-performance, or user dissatisfaction
All such matters fall under your exclusive control and responsibility.
7. Platform Use and Conduct
You agree to use the platform lawfully and ethically. You must not:
Use the system for fraud, illegal activities, or to distribute harmful content;
Reverse engineer, replicate, resell, or offer Digital swecha AI as a public tool;
Violation of these terms will result in suspension or permanent account termination.
8. Termination
We reserve the right to suspend or terminate your access without refund if:
You violate these Terms or applicable laws;
You misuse our brand name or attempt to impersonate Digital swecha AI;
You engage in behavior that damages the integrity or reputation of the platform.
You may terminate your subscription at any time. Cancellation will be effective at the end of your billing cycle. No refunds will be given for unused time after the refund window.
9. Intellectual Property
All intellectual property related to the core software, modules, automation flows, design, and backend systems belong to Gangadhar Bokkena Learning Academy. You are granted a license to use and operate the platform under your business, but you do not own the source code or system IP unless explicitly agreed in writing.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of India. All disputes, if any, shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.

By using Digital swecha AI, you confirm that you understand and agree to these Terms. You further acknowledge that Digital swecha AI serves only as a technology enabler and bears no responsibility for the business you operate on the platform.
